Official Rules
1. NO PURCHASE NECESSARY TO ENTER OR WIN.
2. ELIGIBILITY RESTRICTIONS: “Madness Group’s “Madness 2007” (“Contest”) only open to women currently enrolled as an undergraduate at University of Florida and University of Miami, and who are 18 years or older at the time of entry. A Participant is defined a potential contestant who has been qualified by a Madness 2007 representative and has submitted a signed “Contestant Sign Up sheet”, “Personal Release”, “Personality Profile” and has participated in the Madness Group’s photo shoot (collectively the “Participant Documents”). Employees, officers and directors (including, immediate family of employees, officers and directors) of Madness Group, LLC (“Madness Group”) as well as any affiliated company, subsidiary, distributor, dealer, retailer, co-sponsoring companies and/or any contractor associated with Madness Group and/or this Contest, or any other affiliated promotion are not eligible to participate. All Contest entries must comply with the requirements of these official rules to be eligible to participate.
3. ENTRY DATES AND DEADLINES: The contest has 7 phases. Phase 1 is a preliminary round. The first phase commences on March 3, 2007 at 12:01 a.m. (Eastern Standard Time) and continues until March 10, 2007 at 11:59 p.m. (Eastern Standard Time) (“Phase 1”).
Phase 2, 3, 4, 5 are tournament rounds. Phase 2 commences on March 11, 2007 at 12:00 a.m. (Eastern Standard Time) and continues until March 14, 2007 at 11:59 p.m. (Eastern Standard Time) (“Phase 2”). Phase 3 commences on March 15, 2007 at 12:01 a.m. (Eastern Standard Time) and continues until March 18, 2007 at 11:59 p.m. (Eastern Standard Time)(“Phase 3”). Phase 4 commences on March 19, 2007 at 12:01 a.m. (Eastern Standard Time) and continues until March 22, 2007 at 11:59 p.m. (Eastern Standard Time) (“Phase 4”). Phase 5 commences on March 23, 2007 at 12:01 a.m. (Eastern Standard Time) and continues until March 26, 2006 at 11:59 p.m. (Eastern Standard Time)(“Phase 5”).
Phases 6 and 7 are Finalist rounds. Phase 6 commences on March 27, 2007 at 12:00 a.m. (Eastern Standard Time) and continues until March 31, 2007 at 11:59 p.m. (Eastern Standard Time) (“Phase 6”). Phase 7 commences on April 1, 2007 at 12:00 a.m. (Eastern Standard Time) and continues until April 5, 2007 at 11:59 p.m. (Eastern Standard Time)(“Phase 7”).
Please be advised the above dates are approximate and may be modified if there is a tie between contestants or Madness Group has a technical difficulty that affects the voting process or the website. In the event that any of the dates need to be changed, Madness Group will post a notice and modify these contest rules so that users and contestants will be informed.
4. TO ENTER: To enter the contest, you can sign up with a Madness 2007 representative on campus or at a Madness Group party/ promotion location, can submit an entry form through the website (Participant must have an active e-mail account and Internet access prior to September 30, 2006), call the Madness Group office at (305) 604-5325 and enter over the phone or mail the entry form to 1111 Lincoln Road, 6th Floor, Miami Beach, FL 33139, Attn: Madness Group, Madness 2007 Contest, Entry processing. Entry forms are free and no method of entry is preferred over any other. All entry forms will be processed on an expedited basis but must be received no later than December 15, 2006, though Madness 2007 reserves the right to extend this deadline. Any extension to the deadline will be posted on the website and notice will be published in the respective school student newspaper. All entries will be reviewed by a Madness 2007 representative. All eligible entries will have a chance to participate. All participants must be at least eighteen (18) years old and have submitted the Participant Documents. By entering, Participants agree to abide by these official Contest rules and warrant that they meet the eligibility requirements set forth herein. An eligible entrant or Participant is herein called a Contestant.
5. GENERAL CONDITIONS: Limit one (1) entry per person. Neither Madness Group nor its agencies are responsible for lost, late, damaged, misdirected, illegible, incomplete entries, interrupted or unavailable network, server, Internet or other connections, miscommunications, failed phone or computer hardware or software or telephone transmissions or technical failures, garbled or jumbled transmissions or other errors of any kind, whether human, mechanical or electronic or for exposure to computer viruses or for damage to participant’s computer by accessing Madness Group’ website. It is your sole responsibility to ensure that your entry and Participant Documents are timely and satisfactorily submitted. Entries are the property of Madness Group and will not be returned unless you include with your submission a self-addressed envelope stamped with sufficient postage and a written request for return of your entry. Personal information supplied on registration forms will be used to communicate with Participants about this Contest, for market research, and to send information about Madness Group events, releases and other news and promotions that Madness Group may judge of interest to Participant. Madness Group reserves the right to cancel or modify the Contest if fraud, technical failures or any other factor beyond Madness Group reasonable control impairs the integrity of the Contest as determined by Madness Group in its sole discretion. Madness Group reserves the sole right to extend the deadline of the determinations of the winning entries for one extension period of up to thirty (30) days.
For the avoidance of doubt, all copyrights and rights in and to each entry or other material posted in the course of this contest (including without limitation, photos and blog entries), shall remain the sole and exclusive property of Madness Group. You will, upon request, execute, acknowledge and deliver to Madness Group such additional documents as Madness Group may deem necessary to evidence and effectuate Madness Group's rights hereunder.
Madness Group reserves its rights to verify eligibility qualifications of any entrant and to disqualify any entrant found, in its sole discretion, to be tampering or otherwise interfering with this Contest. Any entrant found to be misrepresenting themselves through the use of aliases and/or addresses or an entrant’s submission of mass entries and/or reproductions will be disqualified. Except where prohibited by law, by participating in this Contest, you are granting Madness Group, and those acting under its authority, permission to use your name, photograph, voice and/or likeness for advertising, publicity and/or other business purposes in connection with the Contest without compensation. This Contest is intended for viewing and participation in the U.S. only and shall only be construed or evaluated by U.S. law.
6. JUDGING/VOTING: The contestants should be judged based on the following criteria (in no particular order): overall attractiveness, personality, creativity, personal style and humor. In Phase 1 and 2, users can vote as many times as desirable. Phase 1 contestants will be composed of up to the top 20 eligible entries in each school as selected by a qualified Madness Group committee consisting of the campus representative and Madness Group officials based on the criteria listed above. In Phase 2 - 7, users may only vote once per day in each tournament. Users will be able to vote every day of the tournament. The highest scoring entry in any tournament or round will proceed to the next Phase. In the event of a tie in any Phase, Madness will host a twenty four (24) hour run off. In the event of a run off the date for each of the remaining phases will be tolled as necessary (by way of example, if there is a tie in Phase 3, Phase 4 will not commence until the tie is broken in Phase 3 and each phase will be pushed back one (1) day).
7. NOTIFICATION: For Phase 1-5, participants should log on to the madness website to see if they have made it to the next round or tournament. Winners of Phase 6 and 7 will receive an email notification if they proceed to the next round (“Finalist”). Finalist will have forty-eight (48) hours from the date of attempted notification to respond to the notification via telephone or e-mail. In the event that any Finalist does not respond to the notification within this forty eight (48) hour period, that Finalist will be deemed to have forfeited his/her chance to compete in the Phase 6 or 7 and the next highest rated contestant will be chosen from the remaining eligible entries. Madness Group is not responsible for late, lost or misdirected notification. Phase 6 will not commence until there are four (4) eligible Finalists, one from each participating school, competing for the grand prize.
Finalists will be required to sign and return to Madness Group a notarized Affidavit of Eligibility (herein “Affidavit”) within two (2) business days of notification. Affidavits sent via facsimile will be accepted in order to comply with the referenced time constraint but the original must be mailed to Madness Group contemporaneously. In the event that a Finalist cannot be contacted, does not meet the eligibility requirements, or fails to return a complete, notarized Affidavit within the specified time period, such Finalists will be deemed in Madness Group’ sole discretion, to have forfeited his/her chances to participate. The Grand Prize Winner will be notified within three (3) business days by email.
8. PRIZES: All eligible Finalists will receive one thousand dollars ($1,000) within fifteen (15) business days of Madness Group’s receipt of all necessary documents, including without limitation the Affidavit. The Winner will receive five hundred dollars ($500) within fifteen (15) business days of notification.
9. Winner agrees that Madness Group and its affiliated companies, parents, subsidiaries, advertising and promotion agencies, and all of their respective officers, directors, employees, representatives, and agents will have no liability whatsoever, and will be held harmless by Winner for any liability for any injuries, losses or damages of any kind to persons, including death, and property resulting in whole or in part, directly or indirectly, from the acceptance, possession, misuse or use of the prize, or participation in this Contest.
10. RULES: Entrants are encouraged to print out a copy of these official Contest rules for future reference. 11. WINNER LIST: To obtain the names of the Winners, send the request with a self addressed stamped envelope to: Madness Group, 1111 Lincoln Road, 6th Floor, Miami Beach, FL 33139; Attn: Madness 2007 Contest, Winner List.
12. VOID WHERE PROHIBITED BY LAW.
